Protecting your privacy is important to Star Performance Academy Ltd. Our privacy policy complies with the requirements of the Privacy Act, which came into effect on January 1, 2004. Protecting your privacy means we will NOT sell, rent or otherwise provide your personal information or our customer lists to persons not associated with the provision of Star Performance Academy Ltd services and merchandise. We collect personal information only with your consent and by fair and lawful means, and for the purpose(s) for which you have given consent. We keep your personal information and the business you do with us confidential, and we employ appropriate security safeguards

Code of Conduct

GENERAL CODE OF CONDUCT: We are an inclusive studio. All who attend or visit are expected to treat staff, students, family and facilities at Star Performance Academy with respect at all times. Behaving in a disrespectful manner may result in removal from Star Performance Academy.

STUDENT CODE OF CONDUCT: Students should show a desire to learn and participate, as well as take care of the space they use. While we understand that children are learning, repeated disruptive behaviour can result in removal from the program or Star Performance Academy altogether.

Acknowledgements

These acknowledgments impact your legal rights.

1. Coronavirus/COVID-19 is highly contagious and I voluntarily assume the risk that I or my child(ren) may be exposed to or infected by Coronavirus/COVID-19 by participating in Star Performance Academy Ltd. programming; and that such exposure or infection may result in personal injury, illness, permanent disability, or death to myself, my child(ren) or other family members or individuals that we may interact with outside of Star Performance Academy Ltd. programming. I understand that many public health authorities may still recommend practicing social distancing.

2. I understand and acknowledge that the risk of myself or my child(ren) becoming exposed to or infected by Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Star Performance Academy Ltd. employees, volunteers, and program participants and their families. I further agree and acknowledge that I am increasing the risk of myself or my child(ren) becoming exposed to or infected by Coronavirus/COVID-19 by participating in Star Performance Academy Ltd. programming.

3. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself, my child(ren), and other family members or individuals that we may interact with outside of Star Performance Academy Ltd. programming, including, but not limited to, personal injury, disability, and death, illness, damage, loss, claim, liability, or expense, of any kind, that I, my child(ren) or other family members or individuals that we may interact with outside of Star Performance Academy Ltd. programming may experience or incur in connection with my or my child(ren) participating in Star Performance Academy Ltd. programming.

Please read, check mark and sign the following in agreement, prior to participation.

4. On my behalf, and on behalf of my child(ren), our heirs, any personal representatives, and next of kin, I hereby release, covenant not to sue, discharge, and hold harmless Star Performance Academy Ltd., and their respective employees, volunteers, agents, representatives, and affiliates, of and from all claims, including all liabilities, claims, actions, damages, costs or expenses of any kind, arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Star Performance Academy Ltd. or their respective employees, volunteers, agents, representatives, and affiliates, whether a Coronavirus/COVID-19 infection occurs before, during or after participation in Star Performance Academy Ltd. programming.

5. I understand that by signing this document, I agree that if I or my child(ren) are exposed to or infected by Coronavirus/COVID-19 during participation in Star Performance Academy Ltd. programming, then I or my child(ren) may be found by a court of law to have waived our right to maintain a lawsuit for a claim of negligence.

6. I represent that neither I, nor my child(ren), have any medical or physical condition which could interfere with our safety in Star Performance Academy Ltd. programming, or else I am willing to assume the risk of and bear the costs of all risks that may be created, directly or indirectly, by any such condition.

7. I have had sufficient time to read this entire document and, should I choose to do so, consult with legal counsel prior to signing. Also, I understand that this activity might not be made available to me or my child(ren) if I were to choose not to assume the risks herein and waive the rights herein, and I agree that the opportunity to participate in return for the execution of this document is a reasonable bargain.

8. I agree that I will practice safe social distancing and clean hygiene during my participation in Star Performance Academy Ltd. programming.

9(a). Neither myself nor my child(ren) are experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell, and I agree that my child(ren) and I will not participate in any future Star Performance Academy Ltd. programming if we are experiencing symptoms of illness.

9(b). Neither myself nor my child(ren) have traveled internationally within the last 14 days, and I agree that neither my child(ren) nor I will participate in any future Star Performance Academy Ltd. programming if we have traveled internationally within 14 days of the programming.

9(c). Neither myself nor my children have traveled to a highly impacted area within Canada winthin 14 days of attending Star Performance Academy Ltd. premises or off-site events, and I agree that neither my child(ren) nor I will participate in any future Star Performance Academy Ltd. programming if we have traveled to a highly impacted area within Canada within 14 days of the Star Performance Academy Ltd. programming.

9(d). Neither I nor my child(ren), have been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by provincial or local public health authorities, and I agree that neither my child(ren) nor I will participate in any future Star Performance Academy Ltd. programming if we are diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by provincial or local public health authorities.

9(e). I do not believe that I or my child(ren) have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19, and I agree that neither my child(ren) nor I will participate in any future Star Performance Academy Ltd. programming if I believe that I or my child(ren) have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.

9(f). I and my children are following all public health authority recommended guidelines and limiting my/our exposure to the Coronavirus/COVID-19, and I agree that neither my child(ren) nor I will participate in any future Star Performance Academy Ltd. programming unless we continue to follow all public health authority recommended guidelines and limit my/our exposure to the Coronavirus/COVID-19.

Release Agreement

Section A: Medical Action Release

In the event of an accident, injury or illness involving myself/my child while attending a studio class or event, I hereby authorize the administration of any medical procedure or first aid deemed necessary by any first aid trained staff member or medically trained selected by the studio staff. I also give permission for myself/my child to be transported to the hospital by ambulance if necessary, and accept full responsibility for all costs which may be incurred with this transportation.

Section B: Liability Release

I am permitting myself/my child to attend class at Star Performance Academy Ltd. I understand that there is an element of risk involved in any activity in which I enroll myself/my child. I hereby accept this risk and release Star Performance Academy Ltd., its staff, and students from any claim that may arise on the premises or on any off-site activity organized by Star Performance Academy Ltd.

Section C: Photography Release

I hereby give permission for myself/my child to be photographed or videotaped as a participant in a studio class or event of Star Performance Academy Ltd. I understand that these photographs may be used as part of promotional materials, social media, keepsakes or in-studio display. I understand that names will NOT be published alongside photos.

Online Learning

"The School" is understood to represent Star Performance Academy Ltd. "The Student" is understood to represent the person participating in classes and is represented by a)themselves if 18 years of age, or older, at the time of participation or b) parent and/or legal guardian of "The Student"

1. Terms

By accessing Star Performance Academy Ltd., you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in Star Performance Academy Ltd. are protected by applicable copyright and trademark law.

2. Use License

Permission is granted to temporarily download one copy of any downloadable materials on Star Performance Academy's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials;

use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

attempt to decompile or reverse engineer any software contained on the School's web site;

remove any copyright or other proprietary notations from the materials; or

The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Star Performance Academy Ltd. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall Star Performance Academy Ltd. be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Star Performance Academy's website, even if the Star Performance Academy Ltd. or an authorized of Star Performance Academy Ltd. has been notified orally or in writing of the possibility of such damage. Any claim relating to the Star Performance Academy Ltd. website shall be governed by the laws of the School Owner's home jurisdiction without regard to its conflict of law provisions.

9. Assumption of Risk

I/we realize that participation in dance, music and/or acting classes and activities could result in some possible personal injury. Despite precautions being taken by Star Performance Academy, accidents and injuries may occur. By signing this release form, I/we (the dancer and parent/guardian) assume all risks related to the use of any and all spaces used by Star Performance Academy Ltd. and offsite, for virtual classes and learning. I/we agree to release from responsibility Star Performance Academy including all teachers, dancers, staff members, contractors and facilities used by both entities from any cause of action, claims, or demands now and in the future. I/we will not hold Star Performance Academy Ltd. liable for any personal injury including: scrapes, bruises, cuts, sprains, fractures, broken bones, concussions or death or any personal property damage/loss, which may occur on the premises before, during or after online classes.

10.Affirmation of Health

I/we affirm that we are of sound mind and health and have been cleared by a registered physician for the physical activity required to participate in the chosen class.

Payment Agreement

ONLINE REGISTRATION PAYMENT AGREEMENT

By registering online, you are automatically signed up for e-payment and you are authorizing Star Performance Academy Ltd. to use the account information for all of your account billing (including registration fee, tuition, costume fees, late fees, recital fees, and any other studio or dance related items purchased on account). You are agreeing to take full responsibility for payment of all charges.

PAYMENT METHODS

1. Star Performance Academy Ltd. accepts credit cards (VISA, MasterCard), and ECHECK/BANK DRAFT

In exceptional cases you may pay by e-transfers, cheque, cash or on-site debit payments. Credit Card must be used to register and kept on file. Please contact the office for details.

2. If paying by cheque please write the student's name in the memo section of your cheque. Cheques should be made payable to "Star Performance Academy Ltd.". Post-Dated Cheques for Full Season Classes: Handed in at the time of Registration, dated the 1st of the month. Cheques will be deposited on that day or the following business day, if it is a holiday or weekend. (Credit Card # must be kept on file)A fee of $25.00 will be charged for each NSF cheque, no exceptions.

3. If you have made alternate payment options with the office and your payment has not been made by the 15th of the month, your amount owing will be charged to your Credit Card on file.

FULL SEASON GROUP CLASSES AGREEMENT (Sept - June)

1. You are purchasing your spot in class for the entire length of the 2020-2021 season. A one time family registration fee in the amount of $39+hst will be charged at time of registration. Starting September 1st, 2020, your total tuition amount will be divided over 10 equal installments and will be billed to your credit card the first of the month until June 1st, 2021.

2. Multi Dance Group Class Discounts (per student): 5% for 2-3 full classes; 15% for 4-5; 25% for 6 or more classes. Should you add or subtract a class, during the first 30 days, or have successfully completed a mid-season Withdrawal Request, your discount will be based upon the new amount of classes you are taking. Private Lessons or 10 week classes are not eligible for discount.

3. Full Season Group Class Commitment Agreement with Our 30-Day Money Back Guarantee. Withdraw within 30 days of the start date of your class, and receive a full tuition refund, for funds already paid.

4. Withdraw after 30 days, and the remainder of the tuition agreed upon remains due, unless paying party presents a doctor's note or proof of change of address to outside of Waterloo Region, which coincides with the dates of the payment agreement. Transfer to a different section or class before January 1st, space permitting, with instructor permission.

5. In the event that Star Performance Academy Ltd. closes the studio due to inclement weather, or any other safety related issues, Star Performance Academy Ltd will deliver your class online.

6. Any cancellation on the part of the student cannot be eligible for refund or rescheduling. If a student misses a class or series of classes for any reason (including, but not limited to illness, holiday, prior commitment, family function), you forfeit your right to reschedule any missed classes and/or to receive a refund.

7. Students ill, or injured for longer than one month may apply for a leave of absence with Doctor's Note with tuition adjustment.

FULL SEASON PRIVATE LESSONS AGREEMENT (Sept - June)

2. For Private Lessons, student will be permitted to dissolve their contract after the first 30 days, but tuition is not eligible for a refund.

Music Lesson Rescheduling: If the teacher cancels due to illness or otherwise, your lesson will be rescheduled at a later date. If the student cancels, your class may be rescheduled at the discretion of the Instructor.

ADDITIONAL PAYMENT TERMS and AGREEMENTS:

FULL SEASON GROUP CLASSES and PRIVATE LESSONS (September - June):

1. Registration Fee: Non-Refundable $39 +HST per family.

2. Late Fee: Tuition is due on the 1st of each month, no later than the 15th. After that time, a $25 late fee will be charged and enforced on all accounts past due, including e-payment accounts. Late fee notices will be sent via email. If the balance is not paid after 30 days late charges will be assessed at $25 + 10% of the balance over $250.

3. Withdraw after 30 days, and the remainder of the tuition agreed upon remains due, unless the paying party presents a doctor's note or proof of change of address to outside of Waterloo Region, which coincides with the dates of the payment agreement. To discontinue enrollment you must fill out a "Withdrawal Form" (available at the front office) and return to the studio office.

4. Any student with an overdue balance of more than 60 days will not be allowed to attend class until payment in full is received or payment arrangements have been made.

5. Accounts that are overdue will not be eligible for registration in the next session/year.

6. In the event of joint custody/joint payment arrangements, both parties will be held responsible for fees owing. It is each contact's responsibility to be in communication with the other party regarding any minor enrolled at the studio. Star Performance Academy must make all account information available to both parties.

DANCE PRIVATE LESSON/SUPPLEMENTAL to CLASS AGREEMENT

1. Payment is due at the time of registration. You must cancel 48 hours before your class to be eligible for a refund. Rescheduling is at the discretion of the instructor.

10-WEEK SESSION AGREEMENT

1. Payment is due at the time of registration. 10-Week Sessions are not available for discounts or bundles.

2. Registration and Insurance Fee: There is a $10.62 +HST registration fee per student participating in 10-week sessions, for new and current students.

3. If a student drops for non-medical reasons tuition is not eligible for a refund. Medical reasons require a doctor's note and withdrawal form in order to be eligible for a refund of remaining classes.

SUMMER CAMP AGREEMENT

1. Payment due in full at the time of registration. Summer Camps are not available for discounts or bundles.

2. Registration and Insurance Fee: There is a $10.62 +HST registration fee per student participating in summer programs, for new and current students.

3. Refund Policy: We must be given 24 hours notice before the start of the camp, at which point you will be given a tuition refund, less a $25 cancellation fee. Student absence for any reason is not eligible for a refund once camp has started.

4. Camp T-Shirts are subject to availability if you register after June 1st.

WORKSHOPS and SPECIAL EVENTS AGREEMENT

1. Payment is due at the time of registration. Workshops and Special Events are not available for discounts or bundles.

ONLINE CLASSES & EVENTS AGREEMENT

1. Payment is due at the time of registration. Online Events are not available for discounts or bundles.

2. Payment is non-refundable.
